National Pollutant Discharge Elimination System (NPDES) Individual Permit Application Forms

An individual permit is an NPDES permit, other than a general permit, issued to a specified person to conduct a discharge at a specified location.  The NPDES Individual Permit is regulated under Hawaii Administrative Rules, Chapter 11-55 (Water Pollution Control).  An application for an NPDES Individual permit must be submitted at least 180 calendar days before the commencement of the discharge.  To request NPDES permit coverage, you must submit the CWB Individual NPDES Form through the e-Permitting Portal and the hard copy certification statement with $1000 filing fee.  Please see the link below for the CWB Individual NPDES Form. 

NPDES permit coverage is required for:   

  • All point source pollutant discharges to State waters.  Point source is defined as any discernible, confined, and discrete conveyance from which pollutants may be discharged.  Examples of point source pollutant discharges include effluent discharges from facilities and effluent discharges from construction (hydrotesting, dewatering, well drilling, etc.).
  • Storm water associated with construction activities for land disturbance of one (1) acre or more of total land area.   NPDES permit coverage is also required for land disturbance of less than one (1) acre of total land area that is part of a common plan of development or sale if the larger common plan will ultimately disturb one (1) acre or more of total land area.  Land disturbance includes, but is not limited to, clearing, grading, grubbing, uprooting of vegetation, demolition (with or without touching the foundation or slab), staging, stockpiling, baseyards, storage areas, paving activities that disturb base course, and all areas used or blocked off to operate construction equipment/vehicles.  Areas blocked off for safety purposes only are not considered land disturbance.
  • Storm water associated with industrial activities.  All facilities with Standard Industrial Classification (SIC) Code(s) categorized in 40 CFR §122.26(b)(14)(i) through 122.26(b)(14)(ix) and 122.26(b)(14)(xi) are required to obtain NPDES permit coverage for discharges composed entirely of storm water runoff associated with an industrial activity(ies).  Please see the link below for the regulated SIC Codes.  You can verify your facility’s SIC Code(s) on your federal tax form.  If your facility has a regulated SIC Code, you will be required to obtain NPDES permit coverage for storm water associated with industrial activities.  If your facility has a regulated SIC Code, but your industrial materials and activities are not exposed to storm water, you may be eligible for a conditional “No Exposure” exclusion.  Additional information on this conditional exclusion is available in this e-Permitting Portal.  Please use the Application Finder button or the Select Organization menu.
  • Storm water discharges from Municipal Separate Storm Sewer Systems (MS4s).  All municipalities (federal, state, and county) in an urbanized area with at least two (2) buildings and a drainage system that discharges to State waters are required to obtain NPDES permit coverage for their MS4.

All discharges related to the project construction or operation activities, whether or not NPDES permit coverage and/or Section 401 Water Quality Certification are required, must comply with the State’s Water Quality Standards.  Non-compliance with water quality requirements contained in HAR, Chapter 11-54, and/or permitting requirements, specified in HAR, Chapter 11-55, may be subject to penalties of $25,000 per day per violation.
