How do I fill out the application if my proposed activity consists of multiple solid waste activities—for example, a MSW landfill facility with vehicle salvaging, green waste mulching, and residential recycling activities?

You need to fill out the general permit application.  In addition to the general information (e.g. facility information, owner and operator information), fill out each of the sections that reflect the type of solid waste activities occurring at the site.  In the example presented in the question, the MSW landfill, composting, salvaging and recycling sections should be completed.

May I use the permit by rule application form?

You may use the permit by rule application form only if your activity falls into one of the four categories and descriptions provided in Hawaii Administrative Rules, Chapter 11-58.1-04(i).  A summary of categories are as follows: (1) convenience centers accepting less than 40 tpd of only residential waste, (2) composting facilities accepting not more than 3,000 tpy of only green waste, (3) land clearing, grubbing and certain agricultural landfills and inert waste landfills of a certain size and specified waste source, and (4) recycling drop-off and single source-separated recyclable processing facilities.  If you are uncertain as to the type of application is required, please contact the Solid Waste Section at (808) 586-4226.

Do all solid waste management facilities require a permit?

Hawaii Administrative Rules Chapter 11-58.1 state that, “It shall be unlawful for any person to establish, modify, or operate any solid waste management facility or a part thereof or any extension or addition thereto without a permit…”  However, there are a few exemptions provided in Hawaii Administrative Rules Chapter 11-58.1-04(b).

How long does it take to process an application for a general solid waste permit?

Assuming that all information requested in the application is provided in a manner that the Department understands the proposed construction and operation of the activity, a determination on a general permit application shall be issued within 180 days of receipt of the complete application.  However, there is no statutory deadline for federally delegated programs, such as municipal solid waste landfills.

How long does it take to process a permit by rule application?

The permit by rule is granted under a 30-day notification process.  Thus, a complete application must be submitted at least 30 days prior to the proposed activity.  After the 30-day notification, the permittee must comply with the conditions of the permit by rule as provided in Hawaii Administrative Rules, Chapter 11-58.1-04(i).  The Director of Health may choose to impose additional conditions on the proposed activity.

Will I receive a reminder notice when my permit is about to expire?

No.  The permittee is responsible to ensure that an application is submitted in accordance with the terms of their solid waste permit and Hawaii Administrative Rules, Chapter 11-58.1, so as to avoid being unpermitted.
